The only reason native title exists in Australia today is that the High Court decided Australia was settled and not conquered. If you want to claim it was stolen through conquest, then there would be no native title in the country.
Maybe the high court over stepped it mark. The Mabo decision was about a tiny Island of Mer not the mainland of Australia.
The people on Mer like the PNG people practised agriculture. The Australian Aboriginal was nomadic and had no defined property boundaries.
